Photo submitted by city as outlined below is of position (2), not related to the pipe broken by the contractor at position (1).

· The photo is of position (2), outlined above. The photo submitted is NOT of the contractor damaged section position (1).

· The photo submitted is of the “transition” area at the street as shown in the top photo above.

· This subsequent photo is clearly knowingly NOT the portion of the pipe damaged by the contractor.

· No sign of any stoppage,

· No mud smears,

· NOT the section of pipe damaged by contractor as outlined below.
